Hypelitix is a web service that analyses and provides public Instagram profile data in an automated and aggregated form to facilitate analysis. The product is focused on B2B marketing agencies in the USA. The service allows you to track the metadata of posts, IGTV and profile stories to filter them by hashtags and mentions.

After registering for service, you will have access to:
◼managing the list of influencers: adding, deleting, sorting and filtering;
◼informational overviews about the influencer's synchronization status;
◼time of the last synchronization attempt;
◼information about cached posts, stories and IGTV;
◼search for cached posts, stories, IGTV by various criteria:
◼date of publication, list of mentions or hashtags.
The platform has integrated Google Cloud Vision API to recognize text in images and videos.

It is forbidden to use the service:
◼if the user is under 16 years old;
◼if the user does not have the required number of credits to perform synchronizations;
◼to change or redirect a service;
◼to resell information received through the service;
◼to create derivative works, reverse engineering and other illegal activities.
We spelled out the service administrator right to block services access
A user accepts that Hypelitix may terminate access to the services for non-payment, intentional misrepresentation of the number of intended syncs or other materials, and violation of the Terms of use.
We fixed payment model depending on the number of synchronizations and prescribed payment methods
Hypelitix supports a variety of payment methods including bank transfers, credit and debit cards, PayPal. The debit occurs if a user manually initiated the synchronization using service or API, or set automatic timer synchronization.
IT lawyers set the terms for debiting and returning funds from the account
Credits from the user's account are debited in the following cases:
◼successful sync result, in which Instagram account data was loaded;
◼unsuccessful sync result if the Instagram account does not exist or is closed, and the Instagram account details were uploaded, but now the link shows a different account.
Funds debited for successful or unsuccessful synchronization are non-refundable.
We created a list of disclaimers to limit Hypelitix liability
◼A user agrees that Hypelitix is not responsible for actions of the payment service provider, additional fees, bank charges or foreign exchange fees.
◼A user understands that data analysis is based on information provided by third-party sources. The data is based on publicly available information and Hypelitix does not verify its accuracy.
◼By using the service, a user warrants having knowledge and experience to assess the risks of information and effectively use Hypelitix as an analytical tool.
GDPR lawyer implemented CCPA disclaimer
Hypelitix does not collect personal data from data subjects, but from the Instagram social network, and cannot inform each data subject of the collection of personal information, except through the Privacy Policy.
We listed influencers’ information the service collects and processes
◼Raw data: all available information from the Instagram social network.
◼Processed Data: ID, username, profile photo link, bio, verification checkbox, number of posts published, number of followings, number of followers, posts, stories, IGTV, post media, IGTV and stories, including the presence or absence of mentions or hashtags, text recognition on images and videos of an Instagram account.
We spelled out the user's rights to access, correct and delete personal data
Users have a full set of rights in accordance with the GDPR, as well as the CCPA, and Hypelitix undertakes to respect their rights. User shall be entitled, inter alia, to request:

◼removal (Art. 17 GDPR; CCPA)
◼processing restrictions (Art. 18 GDPR)

Варто розпочати з того, що ми детально вивчили декілька сторінок видачі Google для того, щоб знайти юридичну компанію, яка спеціалізується на розробці угод користувача англійською мовою з урахуванням міжнародного права (переважно США та ЄС) для проєктів у сфері IT (включно з GDPR Compliance та іншими нормами, специфічними для США). Після вивчення десятка сайтів, які одночасно пропонують вирішення питань у сфері земельного права та “розробку документів для IT”, виникли сумніви, чи правильно ми гуглимо.
